These Terms of Service ("Terms") govern your access to and use of the website located at www.enclaveatthekingsley.com (the "Site"), operated by Edgewood Properties®, Inc. ("Edgewood," "Company," "we," "us," or "our") on behalf of the Enclave at The Kingsley residential community located at 1111 Durham Avenue, South Plainfield, NJ 07080. By accessing or using the Site, submitting a form, or opting in to receive communications from us, you ("you" or "user") agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference.
If you do not agree to these Terms, please do not use the Site or submit your information to us.
1. ELIGIBILITY.
You must be at least 18 years old to submit information through the Site, register interest in a home, or opt in to receive marketing communications from us. By using the Site, you represent that you meet this requirement and that all information you provide is accurate and current.
2. USE OF THE SITE.
The Site is provided to give prospective purchasers information about Enclave at The Kingsley, including floor plans, features, pricing, availability, and community details, and to allow visitors to request additional information, schedule an appointment, or register interest in the community.
You agree to use the Site only for lawful purposes and in a manner consistent with these Terms.

Failure to comply with, or abide by, the above may result in your being prohibited from using the Site, responsible/liable for damages to Edgewood and/or Enclave at The Kingsley, and potential prosecution for violations of New Jersey or Federal law.
3. NO OFFER; RESERVATIONS ARE NON-BINDING.
The Site and any related advertisements are intended solely to solicit non-binding reservations and expressions of interest. Nothing on the Site constitutes an offer to sell, or solicitation of an offer to buy, a home in any jurisdiction where such offer or solicitation would be unlawful. Any reservation made through the Site is non-binding and may be cancelled by the prospective purchaser at any time without cause, and any money paid to Edgewood shall be refunded upon request and cancellation of the reservation, consistent with the disclosures provided on the Site. Actual sales prices, availability, floor plans, features, and delivery timelines are subject to change without notice and will be set forth in a fully executed purchase agreement, if any. Images and virtual tours on the Site may depict model homes or rental residences and may not reflect the specific home you purchase. 4. COMMUNICATIONS AND MARKETING CONSENT.
4.1 Email and General Communications. By submitting your contact information through a form on the Site, you consent to receive marketing and informational communications from Edgewood and/or Enclave at The Kingsley by email and, where applicable, by phone. You may opt out of marketing emails at any time using the unsubscribe link included in each message.
4.2 SMS / Text Message Marketing Program. If you provide your mobile phone number and affirmatively opt in to receive text messages (for example, by checking a consent box on a Site form), you agree to the following terms specific to our SMS marketing program ("Program"):

7. THIRD-PARTY LINKS AND TOOLS
The Site may contain links to third-party websites or tools (such as virtual tour providers or mapping services) that are not owned or controlled by Edgewood or Enclave at the Kingsley. We are not responsible for the content, privacy practices, or terms of any third-party site. Your use of any third-party site is at your own risk and subject to that site's own terms and policies.
8. DISCLAIMER OF WARRANTIES
THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY INFORMATION ON THE SITE (INCLUDING PRICING, AVAILABILITY, OR DELIVERY DATES) IS CURRENT OR ACCURATE.
9. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, EDGEWOOD PROPERTIES AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE SITE OR PARTICIPATION IN OUR TEXT MESSAGE OR EMAIL MARKETING PROGRAMS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100).
10. INDEMNIFICATION
You agree to indemnify and hold harmless Edgewood, 1111 Durham Associates Phase IV LLV and their affiliates, officers, members, employees, representatives, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Site, your violation of these Terms, or your submission of false or inaccurate information.
11. CHANGES TO THESE TERMS
We may update these Terms from time to time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of the Site or continued opt-in status after changes are posted constitutes your acceptance of the revised Terms.
12. GOVERNING LAW
These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws principles. Any disputes arising out of or relating to these Terms or the Site shall be subject to the exclusive jurisdiction of the state and federal courts located in New Jersey.
